Terms Of Use

These Terms of Use ("Terms") govern your access to and use of the mobile application ZeroScam (the "App"), provided by CYBRLAB AI SARL-S ("Publisher"), a company incorporated and validly existing under the laws of the Grand Duchy of Luxembourg. You acknowledge and agree to be bound by these Terms by downloading or using the App. If you disagree, you must cease using the App immediately and delete it from your device. In subsequent App versions, additional consent (e.g., ticking a box) may be required.


1. Definitions

App: The mobile application currently called ZeroScam available for iOS and Android devices.

User: a natural person at least sixteen (16) years of age and utilizes a device on which the App is installed, irrespective of whether such device is owned by the User, a company, an institution, or another entity. The User may also be referred to as "You" in this document.

AI Technology: The artificial intelligence systems and models employed within the App for analyzing user-submitted information and Scam Detection.

Scam Detection: The process performed by the App using AI Technology to analyze user-provided information for potential scams. This analysis results in a scam risk assessment presented to the User as a percentage score indicating the estimated probability that the content is fraudulent, along with a count of similar scam reports submitted by other Users in the same country.


2. Overview

2.1 Purpose of the App

The App is designed to assist Users in identifying potential scams, including but not limited to payment scams and phishing attempts, by analyzing User-provided information. It employs artificial intelligence ("AI") technology to provide Scam Detection recommendations to Users.

2.2 Feedback.

Users may provide feedback via email contact@cybrlab.ai, which may be used to improve the App. Feedback is voluntary.

2.3 Free Usage and Potential Paid Features

The App is currently offered to Users free of charge. However, the Publisher reserves the right, in later stages, to include paid options, premium features, subscription plans, or other monetization models at its sole discretion. In the event of such changes, the Publisher will provide prior notice to Users, including information on the applicable pricing, terms, and conditions of use for any paid features. Users will not be charged without their explicit consent to such paid services or subscriptions.

2.4 Technical Requirements for User’s Requests

The User may submit a request for the App analysis by providing either (i) a screenshot or photo of a message, correspondence, or relevant information in question, or (ii) a textual description of a phone call, communication, or offline situation in own words.

  • File format:The submitted screenshot or photo must be in a format that is supported by the User’s device. The App does not support file conversions or non-standard formats;
  • Maximum number of files per request: 1 file;
  • Maximum text length per request: 1000 characters;
  • Language requirement: Requests must be submitted in one of the languages supported by the App, as available in the App’s settings;
  • Quality requirement: The submitted file must be clear, readable, and of sufficient quality for analysis. Blurry, distorted, or incomplete files may not be processed.

Requests that do not comply with these requirement may not be processed or analyzed by the App. The Publisher reserves the right to decline the analysis of any request that does not meet the specified technical criteria.


3. User Rights and Responsibilities

3.1 The Use of the App

Subject to your compliance with these Terms, the User may access and use the App for the intended purpose. 

3.2 Final Decision

The App provides recommendations only. All decisions regarding the identification and handling of potential scams rest solely with the User. Not all types of scams can be detected by the App. However, the Publisher continues to improve its capabilities.

3.2 Good Faith

The User agrees to utilize the App in good faith and refrain from engaging in unlawful, malicious, unethical, or otherwise improper or harmful activities concerning the App, the Publisher, the Publisher's team, other people (inclusing other Users), entities, insitutions.

3.3 Age Restriction

The App is intended solely for individuals aged sixteen (16) and older.

3.5 Compliance with Laws

The User shall ensure that their way of using the App complies with all applicable local, national, and international laws and regulations.

3.6 Data Submission

The User shall ensure that all requests submitted through the App are accurate, truthful, and provided in good faith. The User must not intentionally submit false, incorrect, misleading, or fabricated information, including but not limited to fake screenshots, photos, or descriptions of events.

The Publisher reserves the right to disregard, decline, or take appropriate action regarding any requests that appear to be intentionally deceptive or fraudulent. Repeated submission of false or misleading information may result in the suspension or termination of the User's access to the App in accordance with these Terms.

The User must refrain from and shall not submit sensitive or certain personal information, including but not limited to:

  • Personal identification and contact details: Name, surname, other names, age, date of birth, identification documents, address, phone number, email.
  • Financial information: Bank card details, account numbers, financial credentials.
  • Private content: Private photographs (including private documents of other individuals).
  • Confidential or legally protected information: Data subject to confidentiality obligations, trade secrets, or information protected under privacy laws.
  • Biometric and health-related data: Fingerprints, facial recognition data, medical records, or any other health-related information.

If such information is present in a screenshot or photo included in the User’s request, the User must take appropriate steps to blur, cover, or crop this data before submission. The Publisher is not responsible for any processing of sensitive data inadvertently and accidentally included in User submissions.


4. AI Technology Disclaimer

4.1 Purpose and Role of AI.

The App utilizes AI technology to analyze user-provided data, including screenshots of User's messages, emails, or descriptions of phone calls, to detect patterns and signs indicating scams. AI technology operates as an assistance tool and does not provide definitive and final conclusions.

4.2 Transparency

The App employs AI algorithms to process data from Users' requests. However, AI algorithms have the following limitations:

  • AI may generate false positive or false negative responses.
  • AI may not always incorporate the latest scam patterns or threats.
  • The scam risk percentage (see p.4.3.) is an estimate and not a guarantee of correctess of the App response; actual risk may vary. 

4.3 Scam Detection Results

The App presents the outcome of its Scam Detection analysis in the form of scam risk indicators. These indicators include:

• Scam risk percentage: A value from 0% to 100% representing the AI’s estimated likelihood that the information submitted in a User’s request is a scam. This percentage is calculated by analyzing the content’s features (such as language patterns, message structure, and known scam characteristics) and comparing them to patterns recognized in scam databases, including consideration of whether similar content has been previously reported by Users (especially within the same country).

• Similar reports count: A numerical count of similar scam reports submitted by other Users in the same country as the User. This indicates how many times content with comparable characteristics has been reported by Users (using the App) in the User’s country, providing context about the prevalence of such content locally.

A higher percentage indicates a greater risk that the User faces a scam according to the AI analysis, while a lower percentage suggests a lower perceived risk. The similar reports count provides additional context but does not independently verify the content’s fraudulent nature.

Importantly, both the percentage and the similar report count are provided as informational tools and do not constitute a definitive determination of the content’s legitimacy or fraudulent status. These scam risk indicators are intended to aid the User’s decision-making and must be interpreted with caution. The App emphasizes, consistent with European Union consumer protection requirements for transparency, that the scam risk output is a probabilistic assessment generated by AI Technology.

4.4 User Autonomy

The App's recommendations (including the scam risk percentage and similar reports count. See p.4.3.) are non-binding. Users must exercise independent judgment (on their own or with the engagement of third parties) in determining the appropriate course of action.

4.5 EU AI Act Compliance

The App complies with the transparency requirements of the European Union Artificial Intelligence Act by providing clear and accessible information about the use and limitations of AI technology in Scam detection.


5. Privacy and Data Protection

5.1 Privacy Measures

The Publisher employs pseudonymization and encryption to safeguard processed data.

5.2 No Registration Required

The App does not require User registration, either prior to the User's request or afterward. However, as detailed in Section 3.5 above, users must refrain from submitting sensitive personal data when using the App.

5.3 Privacy Policy

You may find the Publisher's privacy practices in the Privacy Policy.

5.4 GDPR Compliance

The App and the Publisher adhere to the General Data Protection Regulation (GDPR).

6. Intellectual Property

6.1 Ownership

All intellectual property rights to the App and its content are owned by CYBRLAB AI SARL-S ("Publisher"), except for certain technologies, including AI-based technologies and software, provided by third-party licensors. The rights to these third-party technologies remain exclusively with their respective owners, and the Publisher utilizes them under appropriate licenses in compliance with the applicable license terms.

6.2 License to Users

The User is granted a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes, subject to these Terms.

6.3 Third-Party Technologies

The User acknowledges that the Publisher does not own the intellectual property rights to third-party technologies incorporated into the App and that these technologies are licensed to the Publisher. The User is not granted any rights to sublicense, modify, or otherwise exploit such third-party technologies.

6.4 Prohibited Activities

The User is expressly prohibited from copying, reverse engineering, decompiling, developing software that interacts with the App, attempting to disrupt in any manner the App operations, reproducing, distributing, or otherwise exploiting the App or any part thereof without the prior written consent of the Publisher, except as expressly permitted by these Terms or applicable law.


7. Updates and Modifications

7.1 Updates:

Updates to the App are provided per the User's operating system settings (automatic or manual updates).

7.2 Modifications:

The Publisher reserves the right to modify, suspend, or terminate the App or its features at any time, with or without notice.

7.3 Terms Updates:

These Terms may be updated periodically, with significant changes communicated to Users.


8. Limitation of Liability

8.1 Disclaimer of Warranty:

The App is provided on an "as is" and "as available" basis without any warranties, representations, or guarantees of any kind, whether express or implied. To the fullest extent permitted by applicable law, the Publisher disclaims all warranties, express or implied, including but not limited to:

Fitness for a Particular Purpose:

No warranty is made that the App will meet the User’s specific needs or expectations, including the identification or prevention of scams in every instance.

Merchantability:

The Publisher makes no guarantees regarding the App's quality, reliability, or performance.

Accuracy of Results:

The Publisher does not warrant that the App's results, analyses, or recommendations will be accurate, complete, or error-free. 

Availability and Functionality:

The Publisher does not guarantee that the App will operate uninterrupted, be error-free, or be free from technical issues, including delays or interruptions caused by maintenance, updates, or factors outside the Publisher's control.

8.2 Limited Liability:

The Publisher is not liable for any direct or indirect damages arising from the use of the App, except in cases of gross negligence or willful misconduct under the laws of the Grand Duchy of Luxembourg.

8.3 User Assumption of Risk

The User acknowledges and agrees that:

  • Use of the App is entirely at their own risk.
  • The App is intended as an assistance tool and should not be relied upon as the sole basis for decisions regarding scams or potential risks.
  • Users are solely responsible for verifying and acting upon the information provided by the App.

9. Governing Law and Jurisdiction

9.1 Applicable Law:

These Terms are governed by the laws of the Grand Duchy of Luxembourg.

9.2 Jurisdiction:

All disputes shall be subject to the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg unless alternative dispute resolution methods are agreed upon.


10. Termination of Use

10.1 User Termination:

The User may discontinue use of the App at any time and delete the App from their device.

10.2 Publisher Rights:

The Publisher may suspend or terminate the User’s access to the App for any violation of these Terms, the Privacy Policy, or any App requirements communicated through the App interface, without prior notice to the User.

The Publisher aims to respond to users within 30 days from the date of receipt. Please note that in certain cases, the Publisher may request additional information or clarification from the user in order to process the inquiry effectively. The response timeline may be extended accordingly.

12. Miscellaneous

12.1 Severability:

If any provisions of these Terms are found invalid or unenforceable, the remaining provisions shall remain in full force and effect

12.2 Entire Agreement:

These Terms of Use, together with the Privacy Policy and the App requirements as communicated through the App interface, constitute the entire agreement between the User and the Publisher regarding the use of the App. They supersede and replace any prior agreements, understandings, or representations, whether written or oral, relating to the subject matter herein.


The User acknowledges that no representations, statements, or promises not expressly set out in these documents shall be binding on the Publisher.
